INSURANCE NOTICE AND WAIVER

KaliKosmos Travel, independently contracted with Leone Travel Corp d/b/a Travel Leaders (“we” or “us”) strongly recommends that you purchase insurance for the protection of your health, your property (baggage), and your trip costs and cancellation fees. We also strongly recommend that you purchase a medical evacuation policy. If you decline to purchase these policies, you will personally assume full responsibility for any financial loss associated with your travel arrangements, and you could lose your travel investment and/or have to pay more money to correct the situation.  For example, you will suffer a loss if:  (i) your flight has been cancelled and your tour is nonrefundable; (ii) you need to cancel your trip due to illness; (iii) a hurricane, volcano or earthquake occurs while traveling and you are stranded; (iv) your cruise line, airline, or tour operator files for bankruptcy, unless you have paid by credit card; (v) a terrorist incident occurs at the destination you  planned on visiting; (vi) you have a medical  emergency  and  need  medical  attention  or evacuation; (vii) your bags are lost and your medication is in them, and you need to have an emergency prescription filled; or (viii) your passport and wallet are stolen, and you need emergency cash and a replacement passport.

Please note that, unless you buy a cancel-for-any-reason policy, most policies have a specific clause stating they do not cover events such as pandemics, especially when travel warnings are in place. No representation or description of the insurance made by our staff constitutes a binding assurance or promise about the insurance. You agree to hold us harmless for your election not to purchase travel insurance or for any denial of claim by travel insurer as it relates to any other claim under the policy.

Travelguard's policy has already been added to the cost of your reservation. If you select "decline," will be removed from the total amounts previously listed. If you select "accept" the travel insurance premium will be charged with you initial payment.  This amount will be charged to the card used for the reservation costs unless otherwise specified.  Any additional travel services purchased will require an increase to the travel insurance policy to maintain full protection.  Increases in policy premiums will be charged when the increase is finalized by the insurance company.

YOUR AGREEMENT WITH KALIKOSMOS TRAVEL, I.C. LEONE TRAVEL D/B/A TRAVEL LEADERS

Before we make or finalize arrangements for your trip, we require that you sign below. Your signature will signify your agreement with KaliKosmos Travel, independently contracted with Leone Travel Corp d/b/a Travel Leaders (“we” or “us”) on the following terms and conditions:

1. Travel Documents: You agree to review your itinerary and other travel documents for accuracy and to inform us promptly of any issues. Errors must be reported within 24 hours of ticketing when airfare is included with the reservation. The names on your documents must match your government-issued ID.

2. Agent for Suppliers: We act as a sales agent for any airline, hotel, car-rental company, tour operator, cruise line, or other service provider named in your itinerary or confirmation (“Suppliers”).  Many suppliers, including cruise lines and tour operators, have their own terms and conditions, and we will send you links to them, so that you can read them and agree by checking a box if required. However, if you have not received the link it is up to you, the customer, to ask for the terms and conditions so you may review them. If a supplier requires that we check the box in order to make a reservation on your behalf, you authorize us to do so on your behalf. Air transportation is subject to the individual contract terms of air carriers which are incorporated by reference into every ticket. You can obtain this information at any location where air carrier's tickets are sold. You also have the right, upon request, free of charge, to receive full text of the applicable terms from each of the transporting air carriers. By requesting the agency ticket your reservation(s) you agree to the terms of the Contract of Carriage and all its terms and conditions. We are not responsible for the acts or omissions of the Suppliers or their subcontractors or their failure to adhere to their own schedules, provide services or refunds, financial default, or failure to honor future trip credits. We have no special knowledge regarding the financial condition of the Suppliers or their subcontractors and no liability for recommending a trip credit in lieu of a refund.

3. Risks of Travel and Release: We assume no responsibility for and shall not be liable for the acts or omissions on the part of any other party not under our control or any acts of God, unsafe conditions, terrorism, health hazards including pandemics, illness, weather hazards, or the suitability for a disabled person of any portion of any trip. We have no special knowledge of dangers during travel or at destinations. For information related to such dangers, we recommend going to the State Department travel website at www.travel.state.gov,  click on "Find International travel Information” then click on "Country Information", and  fill in the name of the destination country. For medical and health information, we recommend going to the Centers for Disease Control website at www.cdc.gov/travel, then click on “Destinations” and scroll to the name of the destination country. It is your personal decision to travel, and you are doing so with full knowledge of current travel recommendations and any applicable travel restrictions. YOU HEREBY EXPRESSLY ASSUME ALL OF THESE RISKS AND DANGERS, AND YOU HEREBY EXPRESSLY AGREE TO FOREVER RELEASE, DISCHARGE AND HOLD US, AND OUR AGENTS, EMPLOYEES, OFFICERS, DIRECTORS, ASSOCIATES, AFFILIATED COMPANIES, GUIDES,  GROUP  LEADERS, AND SUBCONTRACTORS HARMLESS AGAINST ANY AND ALL LIABILITY, ACTIONS,  CAUSES  OF  ACTIONS, SUITS, CLAIMS, AND DEMANDS OF ANY AND EVERY KIND AND NATURE WHATSOEVER WHICH YOU NOW HAVE OR WHICH MAY HEREAFTER ARISE OUT OF OR IN CONNECTION WITH THESE RISKS AND DANGERS.

4. Foreign Entry Rules: You assume full and complete responsibility for checking and verifying any and all passport, visa, vaccination, or other entry requirements of your destination and your connecting points, and all conditions regarding health, safety, security, political stability, and labor or civil unrest at such destination. Many countries require your passport to be valid for six months or more after your date of entry. Some countries will not admit persons convicted of a crime. Some countries require both parents’ consent for minors to travel.

5. Fees: By signing this document you agree to pay our Itinerary Management Service fees of  which has already been included in the total cost.  You also agree to pay change, cancellation, refund or other fees. A fee of no less than $25.00 will be charged to explore requested changes.   If the proposed change is approved, an agency fee of no less than  will be charged to confirm changes. If package is cancelled after deposit, an agency cancellation fee will be assessed on the total cost of the reservation.  At this time, the cancellation fee is . If items are added to the package after this agreement is signed, agency cancellation penalties will increase. These fees are in addition to any fees imposed by the supplier and you agree to have the credit card on file automatically charged to pay the fees. All of our fees are non-refundable and we will not waive our fees for any reason including, but not limited to, supplier financial default, travel warnings, and country border closures.

6. Price Drops: If a Supplier drops the price of a trip after booking, we will try to assist you with rebooking if the Supplier allows it, and a fee may apply. We do not guarantee any refunds or successful rebooking.

7. Price Increases: Travel arrangements involving airline and cruise components are subject to Suppliers’ supplemental price increases that may be imposed by the supplier and/or government, even after you have completed your purchase. You hereby consent to any such price increases and authorize your credit or debit card to be used for them. Suppliers have their own contracts covering cancellation penalties and other terms and conditions, and you may be bound by those contracts regardless of whether you receive notice of their terms.

8. Reservation Rule Violations: You agree not to purchase a ticket or tickets containing flight segments that you will not be using, such as a "point-beyond", "hidden-city", or "back-to-back tickets". You further agree not to purchase a round-trip ticket that you plan to use only for one-way travel. You acknowledge that the airlines generally prohibit all such tickets, and therefore we do not guarantee that the airline will honor your ticket or tickets. If you do not use one of the flights in your reservation, the airline will cancel your remaining itinerary, and it may confiscate your frequent flyer points. You agree to indemnify us against airline claims for the difference between the full fare of your actual itinerary and the value of the ticket or tickets that you purchased.

9. Credit Card Merchant: We also strongly recommend that you use a credit card for your purchase, so that you can exercise your rights under the Fair Credit Billing Act if you do not receive the services you purchased.  However, if we are the credit card merchant, our role is to facilitate the sale, collect funds on your behalf, and remit those funds to the Suppliers. If the Suppliers do not provide the services, your only recourse would be against the Suppliers, and you agree not to initiate a chargeback against us.

10. Claims Deadline and Exclusive Jurisdiction: You agree to present any claims against us within 30 days after your trip ends and to file suit within one year of the incident, and you acknowledge that this expressly limits the applicable statute of limitations to one year.  You agree that the courts in Shelby County, Tennessee will be the exclusive jurisdiction for all claims brought by you or us, and you hereby submit to the personal jurisdiction of those courts.

EVERY FAMILY OR PARTY MEMBER 18 AND OVER MUST SIGN.

COVID-19 DISCLAIMER AND RELEASE

Health and Other Hazards: You agree that it is your personal decision to travel, and you are doing so with full knowledge of current travel recommendations and travel restrictions with regards to the risks of COVID-19. We assume no responsibility for and shall not be liable for unsafe conditions or health hazards including pandemics or other illnesses. We have no special knowledge of dangers during travel or at destinations. For information related to such dangers, we recommend going to the State Department travel website at www.travel.state.gov, click on "Find International travel Information” then click on "Country Information", and fill in the name of the destination country. For medical and health information, we recommend going to the Centers for Disease Control website at www.cdc.gov/travel, then click on “Destinations” and scroll to the name of the destination country.

2. Vaccination Requirements and Other Rules: We have no responsibility for COVID-19-related requirements that travel suppliers and governments may impose from time to time, such as required vaccinations, health affidavit forms, COVID- 19 screenings prior to departure or upon arrival, face coverings, or quarantines. For the latest COVID-19 government travel regulations, we recommend going to IATA’s website at https://www.iatatravelcentre.com/international-travel-document- news/1580226297.htm. For the latest travel supplier requirements, check the website of each supplier, and keep checking back because these rules are constantly changing and we are not responsible for those changes.

3. Financial Condition of Travel Suppliers: We are not responsible for the acts or omissions of travel suppliers or their failure to adhere to their own schedules, provide services or refunds, financial default, or failure to honor future trip credits. We have no special knowledge regarding the financial condition of the suppliers, and we have no liability for recommending a trip credit in lieu of a refund.

4. Rebooking: If requested, we will assist with obtaining any refunds due or rebooking trips using future credits, but we will charge a nonrefundable fee for such services.

5. RELEASE: YOU HEREBY EXPRESSLY ASSUME ALL OF THE RISKS AND DANGERS COVERED IN PARAGRAPHS 1-3 ABOVE, AND YOU HEREBY EXPRESSLY AGREE TO FOREVER RELEASE, DISCHARGE AND HOLD US, AND OUR AGENTS, EMPLOYEES, OFFICERS, DIRECTORS, ASSOCIATES, AFFILIATED COMPANIES, GUIDES, GROUP LEADERS, AND SUBCONTRACTORS HARMLESS AGAINST ANY AND ALL LIABILITY, ACTIONS, CAUSES OF ACTIONS, SUITS, CLAIMS, AND DEMANDS OF ANY AND EVERY KIND AND NATURE WHATSOEVER WHICH YOU NOW HAVE OR WHICH MAY HEREAFTER ARISE OUT OF OR IN CONNECTION WITH THESE RISKS AND DANGERS.

6. Please note:

  • Puerto Rico Birth Certificates: Birth certificates from Puerto Rico issued prior to July 1, 2010 are not valid forms of proof of citizenship and are not accepted by U.S. Customs and Border Protection. Guests from Puerto Rico either need to present a *WHTI-compliant document or a government-issued photo I.D. with a validated birth certificate issued after July 1, 2010.
  • Traveling with a Minor: When traveling out of the country with a minor where one or both parents or legal guardians are not present, we strongly recommend bringing an original signed letter from the absent parent(s) or legal guardians authorizing the minor to travel with you. A notarized letter is recommended.
  • Canada Travel: Beware that countries can deny foreigners entry if they have been charged or convicted of a serious crime such as a DWI/DUI as well as insufficient health insurance coverage. For more information on entry requirements review the information on www.travel.state.gov or contact the consulate for the destinations you're traveling to
  • Real ID Identification Requirements: Beginning May 3, 2023, every traveler must present a REAL ID-compliant driver's license, or another acceptable form of identification, to fly within the United States. For more information, go to: https://www.tsa.gov/real-id


TRAVEL DOCUMENTATION

Visas, vaccines, test results, health declarations, and other documents may be required. I understand it is the traveler's responsibility to obtain and carry all required items.

Domestic: Adults are required to show identification when checking in and at TSA checkpoints. Acceptable forms of ID include any state, federal, or tribal identification card, including a passport, military ID card, permanent resident card, border-crossing card, state ID card or driver's license.(A picture ID is required).  Vaccines, test results, health declarations, and other documents may be required. I understand it is the traveler's responsibility to obtain and carry all required items.

International: I have been advised that I need a VALID passport book and that the ticket name will match the name(s) above. Any changes to the passport name given will result in a change fee and/or airfare difference.  Visas, vaccines, test results, health declarations, and other documents may be required. I understand it is the traveler's responsibility to obtain and carry all required items.

It is the traveler's responsibility to verify the validity of the passport. 
Passports must be valid for 6 months after your return date of travel.

Cruise Document Requirements: For cruises that begin and/or end in a U.S port (aka "closed loop cruises"), the following *WHTI- (Western Hemisphere Travel Initiative) Compliant Documents are acceptable for cruise travel. If a picture I.D. is not affixed to the *WHTI-compliant document, a picture I.D. is required (a valid, unexpired government-issued photo I.D. for all guests 16 years of age or older). If the cruise includes air travel to or from Canada or another country, a valid, unexpired U.S. passport is required.

Acceptable forms of identification:

    • Valid U.S. Passport 
    • Valid Passport Card 
    • Valid State Enhanced Driver's License
    • Valid Certificate of U.S. Naturalization

Also acceptable for cruise travel (for cruises that begin and end in a U.S. port, aka "closed loop cruises"), U.S. citizens can show proof of citizenship, such as a birth certificate issued by a government agency and accompanied by a government- issued photo I.D.

    • An original or copy of a birth certificate issued by a government agency (state/county/city) or the Department of Health and Vital Statistics.
    • Internationally adopted children (under the age of 18): If the adoptive parent was not issued a birth certificate, cruise lines will accept as proof of citizenship, a Certificate of Citizenship by the U.S. and adoption paperwork. A Certificate of Citizenship is issued by the U.S. once the adoption is finalized.

Be aware that some ports of call on closed loop cruises may still require a passport book. 
Without a passport book you will not be able to disembark in these ports.
